Terms & Conditions

Lessons and Fees

Lessons may be given in increments of thirty minutes in which case the hourly rate shall be pro-rated accordingly.

Lessons shall take place either online, using a platform mutually agreed by the Parties, or in person at the Student’s home (but alternative arrangements can be discussed if necessary), as shall be agreed by the Parties in advance of each Lesson. The time and duration of each Lesson shall be agreed in advance in writing by the Parties.

The Parties hereby agree that payment for each Lesson shall be due and payable immediately after each Lesson unless otherwise agreed by the Tutor, either in cash or by cheque or by bank transfer to the Tutor’s account, details of which will be specified in writing by the Tutor to the Parent.

The Tutor’s reasonable travel expenses, as agreed by each of the Parties in writing, shall be reimbursed by the Parent to the Tutor following each Lesson.

Covid-19 Precautions:

The Tutor will follow the current Covid-19 guidance set out by the government for private tutors.

Each of the Parties hereby agrees to notify the other in writing in good time before a scheduled face-to-face Lesson if they, or any members of their household, develop symptoms of Covid-19 and/or test positive for Covid-19.

Special Terms:

If the Student is under 18 years old, then the Parent, or other responsible adult, notified as such to the Tutor by the Parent in writing (e.g. a grandparent) prior to a Lesson taking place, must be present in the premises where Student is located for the duration of each Lesson irrespective of whether the Lesson is conducted online or in person.

Cancellation of Lessons:

The Parent may cancel a Lesson by giving the Tutor no less than 24 hours’ prior written notice, in which case no fee will be payable for that Lesson. If insufficient notice is given, or the Student fails to attend the Lesson, then the full fee for that Lesson will be due and payable. If the Student is late, the Tutor will, insofar as is practicable and at his discretion, add corresponding extra time to the end of the Lesson or to one or more future Lessons to make up for the lost time.

In exceptional circumstances, the Tutor may need to cancel a Lesson in which case he will give as much notice to the Parent as possible either by telephone or email and will either reschedule the Lesson at a mutually agreed time or refund any amount previously paid for the Lesson in full to the Parent. If no fee has been paid in advance for any Lesson cancelled by the Tutor, no fee will be payable by the Parent in respect of such missed Lesson.

Notices

Each notice given under this Agreement (each a ”Notice”) must be in writing and sent by email to the email address of the relevant Party set out at the beginning of an agreement between both Parties or to any other email address from time to time designated for that purpose by at least five (5) days) prior written notice to the other Party. A notice under this Agreement is deemed to be received if sent by email: (i) If sent between the hours of 9am and 5pm at the time of transmission; or (ii) If subclause (i) does not apply, at 9am on the day immediately following the day of sending, provided that an email is not deemed received unless (if receipt is disputed) the party giving notice produces a printed copy of the email which evidences that the email was sent to the email address of the party given notice.

Governing Law

The Agreement shall be governed by the laws of England and Wales and the Parties hereby submit to the exclusive jurisdiction of the courts of England and Wales.
